1. Purpose
1.1. This document sets out the Privacy Policy of the software known as “AdventuriQ”. At Aimtech Consulting S.L. we wish to maintain and protect online privacy and want Users to understand how we collect, use and present their personal information. This Privacy Policy applies to the software known as “AdventuriQ” (hereinafter “the application”), comprising a mobile application and a web portal. The application is owned by Aimtech Consulting S.L., with registered address at c/ Carrasco i Formiguera 38, 08173 – Sant Cugat del Vallès – Barcelona (Spain), Tax Identification Number B63564165, registered in the Commercial Register of Barcelona, Volume 36820, folio 66, entry 1, sheet B28747. The company owns the domain www.adventuriq.com and its email address for electronic communications from users and third parties is info@aimtech.es. Use of the application implies acceptance of this Privacy Policy.
2. Data Collected and Stored. Use of Data
2.1. AIMTECH CONSULTING S.L. requests, collects or simply stores a range of data and information that the User enters into the application through any electronic form or data capture sheet, whether during the User registration process on the Website or during day-to-day registration or use of the application. In this regard, AIMTECH CONSULTING S.L. collects and/or stores, among others, the following data:
2.2 During the User registration and sign-up process, personal information from each User of the application will be collected and stored, as required for the provision of the service, verification of identity and prevention of unauthorised use. This data may also be used to respond to any comments, requests, queries or questions from Users. This includes:

2.3. During browsing on the Website, AIMTECH CONSULTING S.L. may collect and store information from your Device in order to generate usage statistics that allow us to improve our products or services and provide better support, as well as for support and maintenance operations. This includes:

Internet Protocol (“IP”) address of the Device.

Browser type.

2.4. During use of the application, AIMTECH CONSULTING S.L. may access, collect, import or store:
Geographic location data of plots, polygons, parcels, estates, enclosures, etc., as required for the provision of the service.
Device geolocation data, to locate plots.
Application usage data from Users. This information will be handled in a dissociated manner (i.e., without personally identifying the User) for market research and internal analysis purposes, as well as for our business partners, in order to improve the quality, reliability and performance of the application, as well as for commercial purposes.

The User’s contacts, provided the User grants access, in order to use the in-app chat module with other Users of the application.
3. Consent to the Processing of Personal Data
3.1. AIMTECH CONSULTING S.L. informs Users that it complies with current data protection regulations and, in particular, with Organic Law 15/1999 of 13 December on the Protection of Personal Data, Law 34/2002 on Information Society Services and Electronic Commerce, and Royal Decree 1720/2007 of 21 December implementing the LOPD. In accordance with said regulations, AIMTECH CONSULTING S.L. states that it only collects data strictly necessary to provide the services derived from the application, under the terms set out in the Terms of Use, and services and activities assigned by law, while reserving the right to use the data in its databases to carry out statistical studies of registered Users and their use of the Website.
3.2. To this effect, and in any case through the voluntary submission of any personal data via any electronic form or data capture sheet provided on the Website or in the mobile application — whether during the registration process or during use of the application as described in Clause 2 above, which are necessary for the processing and management of the service or information request — the User is hereby informed and consents to the incorporation of the personal data provided to the company into the automated file owned by AIMTECH CONSULTING S.L., with registered address at c/ Carrasco i Formiguera 38, 08173 – Sant Cugat del Vallès – Barcelona (Spain), duly registered with the General Registry of Personal Data Protection.
3.3. Likewise, the User expressly consents to AIMTECH CONSULTING S.L. processing their data, as a result of any query, request or contract for any service, or any operation carried out, for the purpose of accessing the information and services provided by AIMTECH CONSULTING S.L. through the application and, where applicable, for the maintenance of the contractual relationship, as well as for the sending of offers or advertising and promotional communications by any means including electronic.
3.4. By accepting the terms set out in this Clause, the User undertakes, during their browsing and/or use of the Website and/or the application, to comply with the obligations set out in this Privacy Policy and to accept the scope of the guarantees granted by AIMTECH CONSULTING S.L. through it, or as may be in force at any given time.
3.5. AIMTECH CONSULTING S.L. undertakes and guarantees the processing of personal data in accordance with applicable regulations as mentioned above and as may be in force at any time, as well as maximum confidentiality with respect to the personal data provided, both on the part of AIMTECH CONSULTING S.L. and its employees who have or may have access to said data.
3.6. AIMTECH CONSULTING S.L. also guarantees that it complies with generally accepted security standards to protect the information provided by the User, both during transmission and upon receipt and storage. We inform the User that we have implemented the necessary technical and organisational security measures to guarantee the security of their personal data and prevent its alteration, loss, processing and/or unauthorised access, taking into account the state of technology, the nature of the data stored and the risks to which it is exposed, whether arising from human action or the physical or natural environment. These measures are recorded in the required Security Document in accordance with Organic Law 15/1999 of 13 December on the Protection of Personal Data. However, it is noted and the User acknowledges that no method of electronic transmission or storage is one hundred per cent (100%) secure. Therefore, AIMTECH CONSULTING S.L. cannot guarantee absolute security, but only maximum diligence in this regard, and accepts responsibility up to that limit.
3.7. Note regarding use of the application by minors. As a general rule, in order to use the application’s Services, minors must have previously obtained the authorisation of their parents, guardians or legal representatives, who will be responsible for all acts carried out through the application by minors in their care. In those Services where it is expressly stated, access will be restricted exclusively to persons over 18 years of age. In any case, we ask the legal representatives of minors to read this Privacy Policy and to assist those in their care in using the application and when providing personal registration data.
4. Accuracy of Data Provided
4.1. The User declares that all data provided by them during the Registration process is true and correct, and undertakes to notify AIMTECH CONSULTING S.L. of any changes thereto.
4.2. In the event that the User provides third-party data during the registration process or while using the application, AIMTECH CONSULTING S.L. shall not be responsible for compliance with the principles of information and consent, and it shall be the User who guarantees that they have previously informed and obtained the consent of the data owner to communicate their data.
4.3. Furthermore, the provision of data is entirely voluntary for the User, although failure to provide certain data or to answer questions that may be posed during the registration process or in the electronic forms presented to the User may result in the impossibility of accessing the services for the provision of which the personal data was requested; AIMTECH CONSULTING S.L. will in any case inform the User of the mandatory and/or necessary nature of providing data for the operation of the service.
5. Consent to the Transfer of Personal Data
5.1. Any such transfer shall be governed, in all cases, by a contract entered into between AIMTECH CONSULTING S.L. and the recipient, clearly defining the purpose for which the data transfer is made.
5.2. We may disclose personal information to our external suppliers and parties that require access to such information in order to provide their services (including, without limitation, transaction/payment processing, data collection and processing, data storage, data security, and technical support services for the Service). Subject to the provisions of Clauses 4.1., 4.2. and 4.3. above, AIMTECH CONSULTING S.L. will not, under any circumstances, disclose personal information contained in its files to third parties without the User’s express consent, and will only use the data incorporated into the files in order to provide the User with access to the service and, where the User has given their consent to this effect, for the sending of commercial communications, product and service information, and/or offers and promotions.
5.4. Likewise, AIMTECH CONSULTING S.L. guarantees that it will not sell, rent or in any profitable manner transfer Users’ personal data, or the means or addresses for communicating with them, except in cases where it is necessary for the provision of the service itself.
5.5 As a general rule, AIMTECH CONSULTING S.L. will not disclose personal information contained in its files to third parties without the User’s express consent, except in the following cases:

When, in good faith, it is necessary to enforce this Privacy Policy and/or the Terms of Use of the application;
When, in good faith, it is necessary to protect the life, property, or safety of ourselves or one or more users;

6. User Rights
6.1. The User has the right to object to the processing of any of their data that is not essential for the conclusion of the Contract and to its use for any purpose other than the maintenance of their contractual relationship, such as processing for advertising purposes. If the User does not agree with any of the processing activities described in this policy, the User may contact AIMTECH CONSULTING S.L. in order to exercise their right to object.

6.3. The User has the right to modify all registration information in the application (such as their email address and access password) at any time.
6.4. The User has the right to cancel their account at any time. Personal data will only be retained for the period required by applicable legal obligations and solely to comply with legal requirements.
7. Access to Software or Third-Party Programmes
7.1. For the proper use of the application and to optimise its resources, AIMTECH CONSULTING S.L. may recommend that you access third-party websites or platforms, or even download and configure third-party software over which AIMTECH CONSULTING S.L. has no control. This Privacy Policy does not apply to such websites, platforms or software. Accordingly, any activity carried out by the User in relation to sites or products outside AIMTECH CONSULTING S.L. must be governed by the terms, conditions, legal notices and privacy policies of those sites or products, for which AIMTECH CONSULTING S.L. accepts no responsibility.
7.2. The foregoing paragraph applies to negotiations, conversations and/or contractual or non-contractual relationships with advertisers or third-party individuals or legal entities contacted through the application.
8. Sending of Offers and/or Communications
8.1. In compliance with Law 34/2002 on Information Society Services and Electronic Commerce, AIMTECH CONSULTING S.L. will exclusively send advertising and promotional offers or communications by electronic means to your email address or via another equivalent electronic communication channel only to those Users who have expressly given their consent to receive such communications. Notwithstanding the foregoing, by accepting the Terms of Use and this Privacy Policy, Users expressly accept and authorise AIMTECH CONSULTING S.L. to send them offers and advertising communications linked to the application.
8.2. The User may express their refusal to receive such communications at any time, by notifying AIMTECH CONSULTING S.L. as provided in Clause 6.2. above or, where applicable, by following the instructions at the end of our emails.
9. Use of Cookies
9.1. A cookie is a small text file stored on the User’s computer or mobile device and retrieved on future visits. There are two types of cookies: persistent and temporary (session cookies). Persistent cookies are stored as a file on the computer or mobile device for a period not exceeding 12 months. Session cookies are stored temporarily and disappear when the browser is closed.

9.3. AIMTECH CONSULTING S.L. informs the User that the Company uses cookies on the Website for the following purposes:
To recognise the User when they log in and to understand how they arrived at the Website, in order to provide relevant information and content to the User.
To remember their preferences when using the features of the Website or the application.
To combat fraud.
To have information about the version of the application the User is using in order to provide new software updates and direct them to the relevant help sections.
To enable access to their account and account services through the software.
To obtain information, metrics and indicators about the Website, such as the total number of visitors and page views.
To monitor the effectiveness and performance of advertisers’ advertising and marketing campaigns and to conduct research with the aim of improving the application and the Website itself.
To implement security measures, such as automatic logout after a certain period of time if the User has not logged in to the account services area for a given length of time.
In the Free Mode without Professional Licence of the application, to provide advertisements or advertising that may be of interest to each User and that is relevant to their interests.
As a general rule, to improve our products and services and to manage and maintain service operations.
9.4. By accepting the Terms of Use and this Privacy Policy, the User expressly accepts and consents to the use of Cookies, although they may choose to reject cookies at any time, either by changing their browser settings (if their browser allows this), by ceasing to use the Website or the application, or by using the relevant opt-out features. Please note that some features are only available through the use of cookies and, if you decide not to accept them, those features may not be available.
10. Use of User IP Addresses
10.1. The User expressly authorises AIMTECH CONSULTING S.L. to store and make use of the IP addresses of application users in order to analyse trends and monitor the use of the applications as a whole. AIMTECH CONSULTING S.L. does not associate IP addresses with personally identifiable information.
11. Amendments to the Privacy Policy
11.1. This Privacy Policy may be modified, amended and/or replaced at any time as a result of possible legislative or case-law changes, changes in the criteria followed by the Spanish Data Protection Agency and/or the competent authority at any given time, or as a result of industry practices, customs and usages, as well as any changes unilaterally decided by the management of Aimtech Consulting S.L., whether or not for the reasons stated above, and in any case the company undertakes to provide the User, in a visible manner, with sufficient information about any changes that may occur in the Privacy Policy. In any event, the User accepts that the Privacy Policy in force at any given time — which they accept as a consequence of their use of and browsing on the Website and/or the application, following any amendment that may have been made — is the one published at any given time on the Website’s home page, which is always accessible to the User. Users may wish to check the Privacy Policy from time to time to stay informed about updates relating to how we use their personal information.
